1. Accettazione dei termini
Accedendo e utilizzando il sito pintime.app e il servizio Pintime, accetti i presenti Termini di Servizio. Se non accetti questi termini, ti preghiamo di non utilizzare il servizio.
2. Descrizione del servizio
Pintime è un sistema di gestione delle presenze che permette alle aziende di gestire le timbrature dei dipendenti tramite geolocalizzazione opzionale o selezione manuale della sede abilitata. Il servizio è in fase di sviluppo (early access) e alcune funzionalità potrebbero non essere ancora disponibili o potrebbero cambiare.
3. Account e responsabilità
L'azienda registrata è responsabile dell'utilizzo del servizio da parte dei propri dipendenti e amministratori. È tuo obbligo:
- Mantenere riservate le credenziali di accesso
- Utilizzare il servizio in conformità con le leggi applicabili, inclusa la normativa sul lavoro e sulla privacy
- Informare adeguatamente i dipendenti del monitoraggio delle presenze, come previsto dalla legge
- Non utilizzare il servizio per scopi illeciti o abusivi
4. Dati dei dipendenti
Pintime agisce come responsabile del trattamento dei dati dei dipendenti per conto dell'azienda cliente (titolare del trattamento). L'azienda è responsabile di:
- Avere una base giuridica per il trattamento (es. contratto di lavoro, legittimo interesse)
- Informare i dipendenti del trattamento dei loro dati di geolocalizzazione
- Rispettare i diritti degli interessati ai sensi del GDPR
5. Esclusione di Garanzia (Servizio "AS IS")
Pintime viene fornito "così com'è" e "come disponibile". Trattandosi di una versione in fase di sviluppo (Beta/Early Access), non forniamo alcuna garanzia, espressa o implicita, di commerciabilità, idoneità a uno scopo particolare o non violazione. Non garantiamo che:
- Il servizio sarà ininterrotto, tempestivo, sicuro o privo di errori.
- I risultati ottenuti (es. report paghe, calcoli ore) siano accurati o affidabili.
- Eventuali errori nel software verranno corretti in tempi brevi.
L'utente accetta che l'utilizzo del servizio in un ambiente di produzione avviene a proprio esclusivo rischio.
6. Limitazione Totale di Responsabilità
Nella misura massima consentita dalla legge, Pintime e i suoi sviluppatori non saranno responsabili per danni diretti, indiretti, incidentali, speciali, consequenziali o punitivi, inclusi ma non limitati a:
- Perdita di profitti, avviamento o dati.
- Interruzione dell'attività lavorativa o danni derivanti da down del sistema.
- Errori nelle timbrature o malfunzionamenti del Geofencing.
- Accesso non autorizzato ai dati.
In ogni caso, la responsabilità complessiva di Pintime verso l'utente non potrà mai superare l'importo totale di €1,00 (un euro) o la somma effettivamente pagata dall'utente negli ultimi 3 mesi.
7. Responsabilità sui Dati e Backup
Sebbene Pintime adotti misure di sicurezza per proteggere i dati, la responsabilità ultima della conservazione delle informazioni e dei backup periodici ricade sull'azienda cliente. Pintime non risponde in alcun modo della perdita definitiva di dati dovuta a guasti tecnici, attacchi hacker o errori umani.
8. Manleva (Indemnification)
L'utente si impegna a manlevare e tenere indenne Pintime da qualsiasi pretesa, danno, obbligo, perdita, responsabilità, costo o debito e spesa (incluse le spese legali) derivanti da:
- Violazione di questi termini.
- Violazione di diritti di terzi (inclusa la privacy dei dipendenti).
- Qualsiasi pretesa che i dati dell'utente abbiano causato danni a terzi.
7. Prezzi e fatturazione
I prezzi indicati sul sito sono indicativi e soggetti a modifica. Durante la fase early access, alcune funzionalità potrebbero essere offerte gratuitamente. Qualsiasi addebito sarà chiaramente comunicato prima dell'attivazione.
8. Cancellazione
Puoi cancellare il tuo account in qualsiasi momento. A seguito della cancellazione, i tuoi dati saranno conservati per 30 giorni (per consentire un eventuale ripristino) e successivamente eliminati in modo permanente.
9. Legge applicabile
I presenti termini sono disciplinati dalla legge italiana. Per qualsiasi controversia è competente il foro di Roma, salvo diversa previsione di legge per i consumatori.

1. Acceptance of terms
By accessing and using pintime.app and the Pintime service, you accept these Terms of Service. If you do not accept these terms, please do not use the service.
2. Service description
Pintime is an attendance management system that allows companies to manage employee clock-ins via optional geolocation or manual selection of authorized workplaces. The service is under development (early access) and some features may not yet be available or may change.
3. Account and responsibility
The registered company is responsible for the use of the service by its employees and administrators. You are obligated to:
- Keep access credentials confidential
- Use the service in compliance with applicable laws, including labor and privacy regulations
- Properly inform employees about attendance monitoring, as required by law
- Not use the service for illegal or abusive purposes
4. Employee data
Pintime acts as a data processor for employee data on behalf of the business customer (data controller). The business is responsible for having a legal basis for processing, informing employees, and respecting GDPR rights.
5. Disclaimer of Warranties ("AS IS" Service)
Pintime is provided on an "AS IS" and "AS AVAILABLE" basis. As an Early Access/Beta service, we provide no warranties of any kind, whether express or implied. We do not guarantee that:
- The service will be uninterrupted, timely, secure, or error-free.
- The results obtained (e.g., payroll reports, hour calculations) will be accurate or reliable.
- Any software defects will be corrected.
The user acknowledges that using the service in a production environment is at their own sole risk.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Pintime and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, goodwill, or data.
- Business interruption or damages resulting from system downtime.
- Clock-in errors or Geofencing malfunctions.
In no event shall Pintime's total liability exceed the amount of €1.00 (one euro) or the actual amount paid by the user in the last 3 months.
7. Data Responsibility and Backup
While Pintime employs security measures, the ultimate responsibility for data retention and regular backups lies with the customer. Pintime is not liable for permanent data loss due to technical failures, cyberattacks, or human error.
8. Indemnification
The user agrees to indemnify and hold Pintime harmless from any claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including legal fees) arising from the violation of these terms or third-party rights (including employee privacy).
7. Pricing and billing
Prices shown on the website are indicative and subject to change. During early access, some features may be offered free. Any charges will be clearly communicated before activation.
8. Cancellation
You may cancel your account at any time. After cancellation, your data will be retained for 30 days (to allow recovery) and then permanently deleted.
9. Governing law
These terms are governed by Italian law. For any dispute, the courts of Rome shall have jurisdiction, except as otherwise provided by law for consumers.

Pintime es un sistema de gestión de asistencia que permite a las empresas gestionar los fichajes de los empleados mediante geolocalización opcional o selección manual de la sede habilitada. El servicio está en desarrollo (acceso anticipado) y algunas funciones pueden no estar disponibles aún o pueden cambiar.
3. Cuenta y responsabilidad
La empresa registrada es responsable del uso del servicio por parte de sus empleados y administradores, incluyendo el cumplimiento de la normativa laboral y de protección de datos.
4. Datos de los empleados
Pintime actúa como encargado del tratamiento de los datos de los empleados en nombre de la empresa cliente (responsable del tratamiento), que debe cumplir con el RGPD y la normativa laboral aplicable.
5. Exclusión de Garantía (Servicio "TAL CUAL")
Pintime se proporciona "tal cual" y "según disponibilidad". Al ser una versión Beta/Early Access, no ofrecemos ninguna garantía, expresa o implícita. No garantizamos que:
- El servicio será ininterrumpido o libre de errores.
- Los resultados obtenidos (ej. reportes de nóminas) sean exactos o fiables.
El usuario acepta que el uso del servicio es bajo su propio riesgo.
6. Limitación de Responsabilidad
En la medida máxima permitida por la ley, Pintime y sus desarrolladores no serán responsables por daños directos, indirectos o pérdida de datos.
En ningún caso, la responsabilidad total de Pintime superará la cantidad de 1,00 € (un euro).
7. Responsabilidad de Datos y Backup
La responsabilidad final de la conservación de la información y de los backups periódicos recae exclusivamente en la empresa cliente.
7. Cancelación
Puedes cancelar tu cuenta en cualquier momento. Los datos se conservarán 30 días y luego se eliminarán permanentemente.

3. Konto und Verantwortung
Das registrierte Unternehmen ist für die Nutzung des Dienstes durch seine Mitarbeiter und Administratoren verantwortlich, einschließlich der Einhaltung des Arbeits- und Datenschutzrechts.
4. Mitarbeiterdaten
Pintime handelt als Auftragsverarbeiter der Mitarbeiterdaten im Auftrag des Unternehmenskunden (Verantwortlicher), der die DSGVO einhalten muss.
5. Gewährleistungsausschluss ("WIE BESEHEN")
Pintime wird "wie besehen" bereitgestellt. Da es sich um eine Beta/Early Access-Version handelt, übernehmen wir keine Gewährleistung.
- Wir garantieren nicht, dass der Dienst unterbrechungsfrei oder fehlerfrei ist.
Die Nutzung erfolgt auf eigenes Risiko des Nutzers.
6. Haftungsbeschränkung
Soweit gesetzlich zulässig, haften Pintime und seine Entwickler nicht für indirekte Schäden oder Datenverlust.
In jedem Fall ist die Haftung von Pintime auf einen Betrag von 1,00 € (einen Euro) begrenzt.
7. Datensicherung
Die endgültige Verantwortung für die Datensicherung und regelmäßige Backups liegt ausschließlich beim Kunden.
